The Court of Federal Claims was created in 1986 as part of the National Childhood Vaccine Injury Act (NCVIA). In response to numerous lawsuits seeking compensation for injuries that children were suffering from vaccinations, Congress created this Act to both shield manufacturers and administrators from liability while providing a more streamlined process for victims seeking compensation for their vaccine injuries. Instead of challenging manufacturers, the adversary in the Court of Federal Claims is always the Department of Health and Human Services (HHS), a government entity. While the initiation of Vaccine Court was based on reports of injuries to children, the Vaccine Court now hears at least equal, if not more, cases stemming from adult injuries.
The Vaccine Court is designed to be a no-fault program, whereby if your injury meets the Vaccine Injury Table requirements, you have a valid claim. Such “table injuries” include encephalopathy or encephalitis, anaphylaxis, shoulder injuries, and vasovagal syncope. In order to qualify as a “table injury,’” the injury must have occurred (1) in response to a vaccine for which that specific injury is listed as a known reaction and (2) within the time frame provided on the table. While table injuries provide for a much more streamlined process, even if your injury does not fall into the no-fault scheme, you may still have an “off-table” claim.
