The Vaccine Court began as part of the National Childhood Vaccine Injury Act (NCVIA) of 1986 in response to lawsuits against vaccine manufacturers for injuries sustained due to vaccine administration. The NCVIA created a no-fault program, whereby if your injury meets the Vaccine Injury Table requirements, you have a valid claim. The table requirements are essentially three parts: (1) the vaccine is covered by the program; (2) the injury is one listed on the table as known to occur after the particular vaccination received; and (3) the problematic reaction occurred within the timeframe specified on the table.
Vaccines covered by the Vaccine Injury Table include Human papillomavirus (HPV), Measles, mumps, and rubella (MMR) vaccine, vaccines containing tetanus toxoid (e.g., DTaP, DTP, DT, Td, or TT), and seasonal influenza vaccines. Even if your injury does not fall into the no-fault scheme, you may still have an “off-table” claim.
The different types of injuries caused by vaccine administration and their levels of severity are wide-ranging. One of the most common injuries, Guillain-Barre Syndrome, also known as GBS. GBS is characterized by neurological issues including weakness and immobility, leading to paralysis in some severe cases. GBS is most commonly associated with the influenza vaccine. Chronic Inflammatory Demyelinating Polyneuropathy (CIDP) is often referred to as GBS’s chronic counterpart because of its characteristic ongoing and often worsening symptoms. Vaccines have been implicated in both the development of CIDP.
Another very common claim is for SIRVA, which has little to do with the type of vaccine and everything to do with the administration. SIRVA is an umbrella term that encompasses many different shoulder injuries that can happen when a vaccine is improperly administered into the wrong location of the shoulder, usually too high. Some common diagnosis that result from SIRVA are bursitis, tendonitis, and tendonosis. This can occur with any type of vaccination.
